1. Agreement to Terms

By accessing or using Tomo ("the Service"), operated by Tomo AI, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

Tomo provides educational content, guided setup resources, and consulting services designed to help small business owners configure and use AI tools effectively. The Service includes:

• Step-by-step AI setup guides, checklists, and prompts
• Business-specific recipe templates
• Consulting and implementation guidance
• Done-for-you setup and onboarding services
• Educational content about AI best practices

Tomo is an educational and consulting service. We do not provide, host, or operate AI software. We help you configure third-party AI tools on your own infrastructure. We are not responsible for the performance, availability, or output of any third-party AI platforms or tools.

3. Accounts and Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Purchases and Payment

Some features of the Service require a one-time purchase. By purchasing, you agree to pay all fees associated with your chosen plan. All fees are stated in US dollars unless otherwise indicated.

• Billing: All purchases are one-time payments charged at the time of purchase.
• Price changes: We reserve the right to adjust pricing at any time. Price changes do not affect previously completed purchases.
• Payment processing: Payments are processed securely through Stripe. We do not store your credit card information on our servers.

5. Refund Policy

All sales are final. We do not offer refunds.

Due to the digital nature of our products and services — including immediate access to guides, prompts, and educational content upon purchase — all purchases are non-refundable. This applies to all plans, including the Setup Guide, 30-Day Consulting Pack, and Done-For-You Setup.

For consulting and done-for-you services, refunds are not available once work has commenced. By purchasing, you acknowledge and agree to this no-refund policy.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Tomo AI, Inc. and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create using our prompts and templates. We grant you a personal, non-exclusive, non-transferable license to access and use the Service for your business purposes in accordance with these Terms.

7. Acceptable Use

You agree not to:

• Redistribute, resell, or sublicense the Service or its content without our written permission
• Use the Service to develop a competing product or service
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract content from the Service
• Use the Service for any unlawful purpose or in violation of any applicable laws

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from using the Service will be accurate or reliable
• AI outputs generated using our prompts or guidance will be free from errors or suitable for any specific purpose
• Any third-party AI tools, platforms, or services recommended or configured through our Service will perform as expected

You acknowledge that AI-generated content should be reviewed before use in your business operations. You are solely responsible for verifying the accuracy and appropriateness of any AI outputs for your use case. Tomo provides educational guidance and consulting only — we do not guarantee any specific business outcomes, revenue increases, or operational improvements.

9. Limitation of Liability

To the maximum extent permitted by law, Tomo AI, Inc., its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any errors, inaccuracies, or omissions in AI-generated content or outputs
• Any actions taken based on our guides, prompts, consulting advice, or setup services
• Any issues with third-party AI tools, platforms, hosting providers, or services
• Unauthorized access to or alteration of your data or transmissions
• Any business losses, downtime, or damages arising from AI agent behavior or misconfiguration

Our total aggregate liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim. You agree to use the Service and any AI tools at your own risk.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
